Last updated: October 6, 2026
DRAFT - not legal advice; pending attorney review before publication.
Effective Date: October 6, 2026
Welcome to KickOff.
These Terms of Service ("Terms") govern your access to and use of the KickOff mobile application, website, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use KickOff.
1. About KickOff
KickOff is a social sports platform that organizes, presents, and facilitates soccer games and helps people connect with other soccer players.
KickOff provides technology that allows users to discover venues and games, create or join games, manage participation, communicate information relating to games, and maintain player profiles.
KickOff is not a sports league, athletic facility, coach, referee, or medical provider. KickOff organizes and coordinates games, but you participate in them at your own risk, as described in Section 4.
2. Eligibility
You must be at least 13 years old to create an account or use KickOff.
If you are at least 13 years old but under the age of majority in your jurisdiction (a "Minor"), you may use KickOff only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and assumes responsibility for your use of the Service.
By using KickOff, you represent and warrant that:
- you are at least 13 years old;
- if you are a Minor, you have obtained the consent of a parent or legal guardian, and that parent or guardian agrees to these Terms on your behalf;
- you have the legal capacity to enter into these Terms;
- the information you provide is accurate and current; and
- your use of KickOff complies with applicable laws and regulations.
We may refuse registration or terminate an account if we reasonably believe these requirements are not satisfied.
3. Your Account
Certain features require you to create an account.
You are responsible for:
- maintaining the confidentiality of your account credentials;
- maintaining accurate account information;
- all activity occurring through your account; and
- promptly notifying us if you believe your account has been accessed without authorization.
You may not:
- share your account with another person;
- create an account for another person without authorization;
- impersonate another person;
- create accounts for fraudulent or abusive purposes; or
- use another person's account without permission.
KickOff is not responsible for losses resulting from your failure to protect your account credentials.
4. Games, Venues, and Physical Activities
KickOff organizes, presents, and facilitates soccer games and related activities through the Service.
You acknowledge that participation in soccer and other physical activities involves inherent risks, including the possibility of:
- physical injury;
- illness;
- collision with other participants;
- property damage;
- unsafe playing conditions;
- transportation-related incidents; and
- other foreseeable or unforeseeable risks.
You voluntarily participate in games and activities at your own risk.
Organizers and captains who coordinate a game through the Service do so only to facilitate scheduling and play. They are not responsible for supervising or ensuring the safety of the game or its participants, and they are not liable for injuries, losses, or damages arising from participation.
KickOff does not guarantee:
- that a game will occur;
- that a game will have a particular number of participants;
- that another participant will attend;
- that a venue will be available or suitable;
- the identity, background, qualifications, or conduct of another user;
- the accuracy of information supplied by users or venues; or
- the safety of any game, venue, participant, or activity.
You are responsible for deciding whether a particular game, venue, participant, or activity is appropriate and safe for you.
If you believe a venue or activity is unsafe, you should not participate.
5. Payments, Cancellation, and Refunds
Some games may require payment to register ("Paid Games"). Whether a game is free or paid is stated when you register for the game.
When you register for a Paid Game, you authorize KickOff to charge the displayed amount through the payment method you provide. Payment processing is handled by KickOff's third-party payment processor (currently Stripe), which collects and processes your payment details in accordance with its own terms and privacy policy. KickOff does not store your full payment card details.
You may also add funds to an in-app wallet that can be applied toward Paid Game registration. Wallet balances are non-refundable except where required by law or where these Terms provide otherwise.
If a Paid Game is cancelled, KickOff will process a refund of the amount you paid for that game. The deadline by which you may receive a refund following a cancellation is stated at the time of registration.
You are responsible for any applicable taxes, fees, or charges associated with your use of the Service.
All fees are stated in U.S. dollars unless otherwise indicated.
6. Messaging
The Service may allow you to send messages to other users, including direct messages and messages or comments relating to games.
You are solely responsible for the content of the messages you send.
Your use of messaging features is subject to the Acceptable Use rules in Section 10 and the User Content terms in Section 8.
KickOff may review, remove, or restrict messages that violate these Terms or applicable law, but is not obligated to do so.
7. User-to-User Interactions
KickOff provides a platform through which users may interact with one another.
We do not conduct background checks on users unless expressly stated otherwise.
We do not guarantee the identity, character, qualifications, behavior, or suitability of any user.
You are solely responsible for your interactions with other users.
Use appropriate caution when meeting people you first encountered through KickOff.
KickOff is not responsible for disputes, injuries, losses, damages, misconduct, or other incidents arising between users.
8. User Content
Users may submit or display information, photographs, text, game announcements, comments, profile information, and other materials through KickOff ("User Content").
You retain ownership of User Content that you submit to KickOff.
However, by submitting User Content, you grant KickOff a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, display, transmit, and distribute that User Content solely as reasonably necessary to operate, maintain, improve, and promote the Service.
This license continues for as long as reasonably necessary for those purposes, including where copies may remain in backups or systems used to maintain the Service.
You represent and warrant that:
- you own or have the necessary rights to submit the User Content;
- your User Content does not violate these Terms;
- your User Content does not infringe another person's intellectual property, privacy, publicity, or other rights; and
- you have obtained any permissions necessary for photographs or other materials you submit.
You must not upload or publish content that is unlawful, fraudulent, threatening, abusive, harassing, defamatory, discriminatory, sexually exploitative, violent, or otherwise inappropriate.
KickOff may remove, restrict, or disable access to User Content that we believe violates these Terms, applicable law, or the safety or integrity of the Service.
9. Profile Photos and Other Images
If you upload a photograph or other image to KickOff, you are responsible for ensuring that you have the right to use and publish that image.
You must not upload images containing another person where doing so would violate that person's rights or applicable law.
KickOff may remove images that violate these Terms or that we reasonably believe create safety, privacy, or legal concerns.
10. Acceptable Use
You agree not to:
- use KickOff for unlawful purposes;
- harass, threaten, stalk, intimidate, or abuse another user;
- impersonate another person or organization;
- provide false or misleading information;
- use KickOff to facilitate fraud or other criminal activity;
- attempt to gain unauthorized access to accounts, systems, or data;
- interfere with the operation or security of the Service;
- introduce malicious software or code;
- scrape, crawl, harvest, or systematically collect information from KickOff without authorization;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service except where applicable law expressly permits it;
- use KickOff to send spam or unauthorized commercial communications;
- use KickOff to discriminate against or harass another person;
- create fake games, venues, accounts, or attendance records;
- manipulate participation, ratings, reviews, or other platform information;
- use another person's account without authorization; or
- attempt to circumvent a suspension, ban, or other restriction.
11. Intellectual Property
KickOff and its licensors own all rights, title, and interest in the Service and its underlying technology, excluding User Content.
This includes, without limitation:
- the KickOff name and branding;
- logos and trademarks;
- software and source code;
- application design;
- interfaces;
- graphics;
- databases and database structures;
- documentation;
- original content; and
- other proprietary materials.
Except for the limited right to use KickOff in accordance with these Terms, no rights are granted to you.
You may not copy, reproduce, modify, distribute, sell, lease, sublicense, publicly display, or create derivative works from the Service without our prior written authorization.
12. Third-Party Services
KickOff may rely on third-party services, including authentication, cloud infrastructure, mapping, geocoding, storage, communications, payment, hosting, and other service providers.
Third-party services may have their own terms and privacy policies.
KickOff is not responsible for the availability, accuracy, security, or performance of third-party services.
13. App Stores
If you download KickOff through Apple App Store, Google Play, or another app marketplace, your use of the application is also subject to that marketplace's applicable terms.
Apple and Google are not parties to these Terms and are not responsible for providing support for KickOff.
14. Availability and Changes to the Service
We may modify, suspend, restrict, or discontinue any part of KickOff at any time.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
The Service may be unavailable because of maintenance, technical failures, third-party services, network failures, security incidents, legal requirements, or circumstances beyond our reasonable control.
We may introduce, remove, or modify features as KickOff develops.
15. Account Suspension and Termination
We may suspend or terminate your account or restrict your access to KickOff if:
- you violate these Terms;
- you engage in fraudulent, abusive, threatening, or unlawful conduct;
- your use presents a risk to other users or the Service;
- we are required to do so by law; or
- we otherwise reasonably determine that suspension or termination is necessary to protect KickOff, its users, or third parties.
You may stop using KickOff at any time.
Termination does not eliminate obligations that by their nature should survive termination, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
16. Privacy
Your use of KickOff is also governed by our Privacy Policy.
The Privacy Policy explains what information we collect, how we use it, how we protect it, when it may be shared, and the choices available to you.
Our Privacy Policy is available at:
https://kickoffgames.net/legal/privacy
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KICKOFF IS PROVIDED "AS IS" AND "AS AVAILABLE."
WE DO NOT WARRANT THAT THE SERVICE WILL BE:
- UNINTERRUPTED;
- ERROR-FREE;
- SECURE;
- ACCURATE;
- COMPLETE;
- RELIABLE; OR
- AVAILABLE AT ANY PARTICULAR TIME OR LOCATION.
WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF INFORMATION PROVIDED BY USERS, VENUES, ORGANIZERS, OR OTHER THIRD PARTIES.
KICKOFF DOES NOT GUARANTEE THE SAFETY, QUALITY, LEGALITY, OR SUITABILITY OF ANY GAME, VENUE, PLAYER, ORGANIZER, OR OTHER USER.
YOU ARE RESPONSIBLE FOR YOUR OWN DECISIONS REGARDING PARTICIPATION IN ANY GAME OR ACTIVITY.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited under applicable law.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KICKOFF AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM OR RELATED TO:
- your use of or inability to use KickOff;
- your interactions with other users;
- participation in or travel to or from a game;
- injuries, accidents, or property damage;
- conduct of other users;
- venues or venue operators;
- User Content;
- third-party services; or
- interruption or termination of the Service.
To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service will be limited to the greater of:
- the amount you paid to KickOff for the Service during the twelve months preceding the event giving rise to the claim; or
- $100.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
19. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless KickOff and its owners, officers, directors, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses, including reasonable attorneys' fees, arising from or related to:
- your violation of these Terms;
- your violation of applicable law;
- your User Content;
- your misuse of the Service;
- your infringement of another person's rights;
- your interactions with other users; or
- your participation in games or activities arranged through KickOff.
20. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may provide notice through the Service, by email, or by other reasonable means.
The updated Terms will become effective on the date stated at the beginning of the updated Terms.
Your continued use of KickOff after the effective date constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
21. Governing Law and Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
To the extent a dispute is not subject to arbitration as described in Section 22, any such dispute arising from or relating to these Terms or the Service will be resolved in the state or federal courts located in New York, New York, unless applicable law requires another forum or provides you with a non-waivable right to bring a claim elsewhere, such as in your state of residence.
22. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal resolution. Before filing a formal claim, you and KickOff agree to try to resolve any dispute informally. You agree to notify us of your dispute by contacting KickOff using the contact information in Section 26. We will contact you to try to resolve the dispute. If the dispute is not resolved within 30 days of your notice, either party may proceed as described below.
Agreement to arbitrate. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (available at https://www.adr.org), and not in a court of law. The arbitration will be conducted before a single arbitrator, and judgment on the award may be entered in any court having jurisdiction.
CLASS ACTION WAIVER. YOU AND KICKOFF AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. UNLESS YOU AND KICKOFF AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
Exceptions. This arbitration agreement does not apply to, and either party may pursue in court: (a) an action brought in small claims court, provided the claim qualifies and remains in that court; or (b) a claim seeking injunctive or other equitable relief for the alleged infringement or misappropriation of intellectual property rights.
30-day opt-out. You may opt out of this arbitration agreement and the class action waiver by sending written notice to KickOff within 30 days of first accepting these Terms. The notice must include your name and the email address associated with your account, and state that you are opting out of the arbitration and class action waiver provisions of the Terms. Opting out will not affect any other part of these Terms.
Arbitration details. The arbitration will be held in New York, New York, or another mutually agreed location, or by videoconference, or, for claims of $10,000 or less, by written submissions. The AAA rules will govern the payment of filing, administration, and arbitrator fees, except that KickOff will pay them to the extent required by the rules or applicable law. Each party is responsible for its own attorneys' fees and costs, except as the arbitrator may award under applicable law.
Severability. If the class action waiver or any other part of this Section is found to be unenforceable, that part will be severed and the remainder will remain in effect, except that if the class action waiver is found unenforceable, then the entire agreement to arbitrate will be unenforceable and the dispute will proceed in court.
23. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.
24. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
25. Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement between you and KickOff concerning your use of the Service.
They supersede prior agreements concerning the same subject matter, except where expressly stated otherwise.
